This is a client. My company gave a letter from immigration department saying EAD is a valid document to work. But their security team is just adamant saying they need valid visa & I94. So What helps me is some thing that says EAD is valid for legal employment or it is not legal to descriminate based on the status.

I even have valid drivers licence etc. still they don't see it as valid.

I 9 form does have i 766 as valid entry.

If you have EB3 2002 labor approved( I have not seen that in your post) now.
If the above statement is true, then File another labor in EB2 through perm which will be approved in 6 months.
Get I-140 of both EB3 and EB2 labor approved via premium.
USE EB3 priority with the EB2 labor, that means you can file for I-485 and get EAD because the proprity date EB2 category is accepting is Jan-2003 and your priority is June 2002.

Think on this, ask your employer and lawyer, couple of my friends are doing this.

In max six months time you will be eligible for I-485

Thanks for the tip, I'm going to experiment. It's good to have a bunch of different tools and techniques, not all images behave the same in Photoshop.

I am beginning to really like the 100-400, as was a bit worried as the first few images were not good at all, but as I learn how to use it I see it's all my fault. :)

This is NOT labor substitution - but another proposed rule that would invalidate any labor certs taht were not followed up with a I-140 within 45 days.

Can we also port the PD if second I-140 is already approved, and file I-485 while using old PD?
this rule is part of the labor substitutuion elimination rule which limits lc to 45 days life.

One thing I don't understand is how come this guy used the words bastard, communist china(all the time),cheap labor for computer programmers and he is so full of himself. Why does he have problem if US borrows flights from russia to transport vehicle?

Sorry to say this is gone case. Try exploring the option of filing another I-140with the other approved labor you have. Also, make sure that labor has provisions to make your new I-140 approvable. Otherwise, you will be hitting against the wall twice!!

If I marry someone from my home country India and she is working out there as a physiotherapist, can she come here and start practicing immediately or she needs to give some exams and do I need to file her H1 - B in the quota opening in April or is she outside the quota?

It's a bit of a guess without seeing the images, however when the light source i.e. a lamp, or a window is in the picture area it forces the camera to average its brightness into the exposure calculation. The result = dark pictures. I remember way back when when I was just getting started I had no Idea how dark it realy was when I started shooting indoors. Uping the sensitivity As previosly described is most likely necessary. (either that or a tripod, and neck clamps for your subjects as was done in the days of tintypes.) You might also consider bouncing a flash off of a white ceiling or wall to soften the light and avoid the harsh lighting you have learned to dislike.

Hi,
We applied for EAD and Adv parole renewal on July 2nd for my wife. Her new EAD card was received in September and no word on the Adv Parole yet. Online status still shows 'case received and pending'.
She had her previos Adv Parole expiring on Oct 22nd. She left to India on Oct 1st. Now that her previous Adv Parole has expired and new one still not approved, will they allow her to enter US?

I did some research on traveling with AP. AFAIK it has to be approved while you are in US - especially if you are an AOS applicant.

Folks,

We need to understand that we have chosen a tough but worthy effort in the form of this forum. As such it may be depressing to see the slow movement in DC.

We should not be setting ourselves some timelines like the ones stated in this email thread, and then feel depressed about seeing no positive results within that timeline...there are too many factors outside our control to do anything like that...

I think we are better off than we where we were last year, when the awareness was nil, and that backlog legislation only favored the RNs and the PTs, while we saw ourselves powerless...

Lets help the core team..and not get depressed over short timelines...I see light at the end of our efforts...may not be phenomenal..but I am sure it will make a difference...for each of us...

I was also taken aback initially when I read this. The 8 year wait doesnt apply to title 5. Title 5 already is designed to clear the backlog of EB immigration from 6 years to 0/at best minimum since quota is increased and there are exemptions. The 8 year backlog refers to family based.

I believe consular processing can be used only if the dates are current. It might take a long time for 2003 April EB3 India to be current. Since Green Card is for future employment, is there anyway to continue the Green Card process while in India ??

Friends,

As I had indicated that I had admission to study for MBA in europe starting Sep/Oct 2007, looks like I have to drop it due to the GC process ( entangled)

My last discussion wirh Immi and employer drove the nail in the coffin.

I would appreciate any suggestion fromfolks like you.

Outcome:

I can quit the job and proceed for MBA at my risk ( leave spouse behind in the US in I-485 pending stage). If for example my PD ( July 2002 EB3 india) comes up during my absence in the US and if there is a RFE, my current employer WILL NOT provide a job offer so far into the future ( ie post Sep 2008). the least they said they can do is not pull labor and I-140 ( both approved and I-485 pending for 4 yrs)

Since I am in the Mechanical egnineering field , i dont know who to find , ( unlike adundant software body shoppers present) who will draft an offer in case of RFE.

I have few more weeks before I see this opportunity slip by.

Can anyone guess if the EB3- India PD will move to July 2002 or beyond before September 2008?

Any suggestion./directions will be appreciated... Around me i have no one who has even changed jobs , used AC21 etc.

1. She's eligible to get the I-94 expiry date as July 2008
2. As 1 above, but even if she gets July 2007 there's no real difference; she's legally admitted till July 2008 (from the I-94 on the I-797) and for any travel post-July 2007, she'd need a visa stamp anyway.
3. Since the re-entry is so close to the visa expiry, the POE officer may say something like "hmm...your visa is expiring in July 2007" which is a good time to show the new approval and get the later date. Otherwise also, it's prudent to show the new approval and get the updated I-94.

I think we may have spoken about this , but here is my question :

My wife has her passpot with visa stamped till June 2007 from my previous company. She has a new I-94 extended till 2008 July. She will be going to India in March and will be back in May (before June 2007 expiry of the visa on her passport). Here are my questions :

1. Will at the port of entry she would get the June 2007 on her I-94 or the extension I-94 date of July 2008. I know it will depend on the POE officer, but I want to know what has been the experience of such cases...?

2. In case she gets June 2007 on the I-94 at POE, can I get it corrected at the local CBP office to July 2008 after she is home here in US? Remember it's not a mistake by the POE officer but he/she giving preference to visa stamp and not the extension paper ?

3 Does it make sense for my wife to remind before hand about the extension at the POE and argue it ? Has anybone done that and is it safe ?

Fellow IVians:

Background:
We are one EAD/AP. (may not matter in this scenario but still mentioning)
My daughter is a US born Citizen and she is under 2 years old with a valid Indian VISA.
She has been living in India with her Grand Parents for the past one year.
She will be travelling to the US accompanied by her uncle & Aunt who are returning to USA at the end of their vacation.

Question:
Since both parents are not accompanying the infant is there some documentation needed?
Has anyone done this before? Can you please post your experiences and suggestions?
I will be preparing a notarized letter of consent along with her Birth Certificate...is there anything else?

Any information will be sincerely appreciated

So, did you follow up later...to see what happened on your case or are you just waiting. My lawyer says that the timelines are just like that.

I am in the same boat and my case was filed on apr 3 and mine is eb3 nebraska.
even my employer opened a service request.
